Terms of Use

These terms govern your use of the Findy application and this website. Please read them before using the app, and particularly the sections on what Findy can and cannot detect.

These terms are a starting point written by the operator, not finished legal advice. They have not been drafted or reviewed by a qualified lawyer. If you are relying on this document for anything of consequence, have a lawyer in the relevant jurisdiction review it first — and complete the governing-law section marked below.

1. Acceptance of these terms

By downloading, installing or using Findy ("the app"), you agree to these Terms of Use. If you do not agree with them, do not use the app. If you are using the app on behalf of an organisation, you confirm you are authorised to accept these terms on its behalf.

Findy is provided by Azat Goktas ("we", "us", "the operator"), an independent developer.

2. What the service is

Findy is an inspection aid. It uses your device's existing hardware — the camera, the Bluetooth radio, the network interface and the magnetometer — to surface things in your surroundings that may be worth looking at more closely. It also provides a guided checklist for inspecting a room by eye.

Findy does not classify, identify or verify any object. It reports observations. Interpreting those observations, and deciding what to do about them, is yours to do.

3. No guarantee of detection

Findy cannot guarantee that it will find every hidden camera, microphone, tracker, recording device or other device in any given space, and it must not be relied upon as the sole means of assuring your privacy, security or safety.

Every method the app uses has documented failure conditions. Among other limits, Findy cannot detect devices that are powered off, devices that do not transmit, devices on a network you are not connected to, devices connected over a cellular network, wired devices with no network presence, devices shielded by building materials, or devices restricted from third-party apps by the operating system. Camera-based checks depend on your specific hardware, the lighting and the viewing angle, and may show nothing where a device is present.

Equally, Findy may draw your attention to entirely ordinary objects. A reflection, a magnetic reading, an unidentified network device or a nearby Bluetooth advertisement is not evidence of surveillance.

The full technical account is published at how it works and limitations, and both form part of your understanding of what the app does. Use of Findy is at your own risk and judgement, and is not a substitute for professional counter-surveillance services, legal advice or contacting the police where a crime may have been committed.

4. Acceptable use

You agree to use Findy only for lawful purposes, and only in spaces you occupy or are entitled to inspect. You must not use the app, or anything you learn through it, to:

Network scanning is regulated differently in different countries. Scanning a network you have not been authorised to scan may be unlawful even when you are a paying guest on it. You are responsible for knowing the rules that apply where you are.

We may withdraw access to the app, or to support, where we reasonably believe these terms have been breached.

5. Subscriptions and billing

Findy is free to download. Some features — the camera tools and the network scanner — require Findy Pro, an annual auto-renewing subscription.

All purchases are processed by Apple. We do not handle payments and we cannot issue refunds. Refund requests are made to Apple at reportaproblem.apple.com, and the decision is Apple's alone. Full details, including cancellation and restore steps, are on the pricing page.

We may change the subscription price. A price change takes effect at your next renewal, and Apple notifies you in advance and, where required, asks you to consent before the change applies.

6. Licence and intellectual property

Findy is licensed to you, not sold. Subject to these terms, you receive a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, in line with the App Store terms.

The app, its source code, its interface, its written content, this website and the Findy name remain the property of the operator and are protected by copyright and other laws. Nothing in these terms transfers any of those rights to you.

Unless a separate end user licence agreement applies, your use of the app is also governed by Apple's standard licence terms: Apple's Licensed Application End User Licence Agreement. Where those terms and these terms conflict on a matter Apple's terms govern, Apple's terms apply.

7. Disclaimer of warranties

The app is provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory, to the fullest extent permitted by law. We do not warrant that the app will be uninterrupted, error-free, compatible with any particular device, or that its results will be accurate, complete or fit for any particular purpose.

In particular, and without limiting section 3, we give no warranty that the app will detect any device, that an absence of results means an absence of devices, or that a result the app surfaces indicates a real concern.

Nothing here excludes or limits any right you have as a consumer that cannot lawfully be excluded or limited.

8. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive loss, or for any loss of profits, revenue, data, goodwill or opportunity, arising out of or connected with your use of the app — including any loss arising from a device the app did not detect, from a result you interpreted as indicating a device, or from any action you took in response to a result.

Where liability cannot be excluded, our total aggregate liability arising from or connected with the app is limited to the amount you paid for it in the twelve months before the event giving rise to the claim.

We are not liable for the acts of third parties, including anyone who has placed a device in a space you inspect, or for the conduct of network operators, accommodation providers or platforms.

Again, nothing here excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

9. Changes to these terms

We may update these terms as the app changes or as the law requires. The effective date at the top of this page always reflects the current version. Where a change is material we will note it prominently on this page or in the changelog. Continuing to use the app after a change takes effect means you accept the revised terms; if you do not accept them, stop using the app and cancel any subscription.

10. Governing law and jurisdiction

No governing law has been designated yet

These terms do not currently designate a governing law or a court with jurisdiction over disputes, and nothing on this page should be read as doing so. Your own consumer rights in your country of residence are unaffected by that omission.

This section is left open rather than filled with a guess. It will be settled with a qualified lawyer and completed here before these terms are relied upon.

11. Severability and entire agreement

If any provision of these terms is found unenforceable, the remaining provisions continue in force. A failure to enforce a provision is not a waiver of it. Together with the privacy policy, these terms are the entire agreement between you and the operator regarding the app.
